Ireland: New High Court Rules Establish the Procedural Framework for Consumer Representative Actions
On 12 October 2026, new rules governing consumer representative actions before the Irish High Court entered into force. The Rules of the Superior Courts (Representative Actions for the Protection of the Collective Interests of Consumers Act 2023) 2026 provide a dedicated procedural framework for Ireland’s implementation of Directive (EU) 2020/1828.
The rules address admissibility applications, information concerning funding and represented consumers, the maintenance of opt-in consumer lists, case management and judicial approval of settlements. They also specify procedures for seeking injunctions and implementing redress measures.
This development represents an important step in the practical operation of Ireland’s representative actions regime. It provides qualified entities and defendant businesses with clearer procedural guidance and illustrates the contribution of case-management rules to effective collective consumer protection.
