214 Companies Call for Mandatory Disclosure of Third-Party Litigation Funding under Rule 26
On 14 September 2026, 214 companies submitted a letter urging the Advisory Committee on Civil Rules to introduce a uniform disclosure requirement for third-party litigation funding under Rule 26 of the Federal Rules of Civil Procedure.
The proposed amendment would require disclosure of funders’ identities and the agreements governing their financial participation. The signatories argue that such information would assist courts and parties in identifying interests and decision-making powers affecting litigation and settlement.
Registered as Rules Suggestion 26-CV-31, the submission contributes to the debate over transparency, judicial supervision and the governance of funded litigation, including collective proceedings.
