The Observatoire des actions de groupe draws attention to the publication of the sixth annual CMS European Class Action Report. Published on 8 October 2026, the report examines European collective litigation from the perspective of corporate litigation risk.

The report records 107 new proceedings in 2025, compared with 99 in 2024. Its findings indicate sustained geographical differences, alongside growth in Austria and Italy across several sectors and causes of action. Consumer and competition claims remain prominent, with product liability, personal injury and data protection also featuring among the principal areas of litigation. US Big Tech companies account for the largest number of reported claims by defendant sector for the first time.

The publication also examines implementation of the Representative Actions Directive, developments in climate litigation and product liability, and Spain’s proposed opt-out framework. It identifies increasing coordination among claimants pursuing proceedings concerning the same alleged conduct in several jurisdictions.

These findings should be read within the report’s methodological scope: its dataset covers collective proceedings involving at least five economically independent claimants seeking damages, including declaratory proceedings intended to support subsequent compensation. The statistical reference date is 31 December 2025; the legal commentary reflects developments through 1 September 2026.
